Website Design & Development Agreement
This Website Design & Development Agreement (“Agreement”) is entered into by and between SB Media Hub, LLC (“Developer”) and the undersigned client (“Client”) regarding the design, development, and delivery of web-related services.
1. Scope of Work
Developer will design and develop a website for Client using SB Media Hub’s proprietary platform. The project includes setup, design, layout, and integration of Client-provided text, photos, videos, and media.
Included Deliverables (as applicable to Client’s chosen package):
- Custom website design and setup on SB Media Hub’s platform
- Hosting support and domain connection assistance
- On-site SEO setup (titles, meta descriptions, sitemap)
- Photo and video integration
- Contact/inquiry forms sending directly to Client’s email
- Display of Google Reviews (if available)
- Location map integration
Optional Add-Ons (separate fees apply):
- Logo design
- Photography / Videography
- Professional headshots
- Content writing
- Business card design
- Flyer & brochure design
- Google My Business listing setup and optimization
- Domain email forwarding setup
Developer is responsible only for the services explicitly listed above. Any services not listed are not included.
2. Timeline
Estimated completion time is 2–4 weeks after all required materials (text, images, logos, business details) are received from Client. Delays in providing materials, approvals, or communication will extend this timeline.
3. Payment Terms
Website fees are based on the selected package:
- Starter Care Website: $799 — Includes 1 year of hosting and maintenance; $50/year thereafter.
- Standard Care Website: $1,599 — Includes 2 years of hosting and maintenance; $100/year thereafter.
- Premier Care Website: $2,599 — Includes 3 years of hosting and comprehensive maintenance; $150/year thereafter.
Payment Schedule:
- 50% deposit due at signing.
- 50% balance due upon completion and prior to launch.
All payments become non-refundable once design work begins. Hosting renews annually after the included period unless canceled in writing at least 30 days before renewal.
4. Platform Ownership & Usage Rights
Client owns all final text, images, and media they provide and any custom content created specifically for Client after full payment. Developer retains full ownership of the SB Media Hub platform, website templates, code, structure, CMS, and proprietary tools.
Client receives a non-exclusive license to use the website hosted on SB Media Hub’s platform. Migration to external hosting is possible, but platform-specific features may not function. Developer provides no guarantee of compatibility outside SB Media Hub.
5. Client Responsibilities
Client agrees to:
- Provide accurate information, text, images, and business details in a timely manner.
- Review drafts and provide feedback promptly.
- Approve final content before launch.
- Ensure all content complies with applicable laws, licensing, and industry regulations.
- Maintain access to email accounts and listings connected to the site (Google Business Profile, domain host, etc.).
Developer is not responsible for delays caused by missing materials or slow approvals.
6. Revisions
The project includes two (2) rounds of design revisions during development. Additional revisions or major redesigns may incur extra fees. Post-launch updates fall under hosting and maintenance guidelines.
7. Hosting & Maintenance
SB Media Hub Hosting Includes:
- Server uptime monitoring
- Security patches
- Backups
- Platform updates
- Minor text/image updates (within reason)
External Hosting:
If Client migrates the site elsewhere, Developer is not responsible for uptime, performance, security, updates, or broken features.
8. No Guarantee of Traffic, Leads, or Ranking
Developer provides SEO best practices, but cannot and does not guarantee:
- Google ranking or placement
- Search visibility
- Traffic volume
- Lead quantity
- Review performance
- Google Maps placement or verification
Client understands that all search results are controlled by algorithms outside of Developer’s control.
9. Communication Policy
Developer provides support only for the services listed in this Agreement. Services not listed—including business consulting, IT troubleshooting, domain provider support unrelated to hosting, or third-party account issues—are not included.
All communication is handled via email, text, or scheduled phone calls.
10. Termination
Either party may terminate the Agreement prior to project completion. Client remains responsible for payment of all work performed up to the termination date. Deposits are non-refundable once work begins.
11. Limitation of Liability
Developer is not liable for:
- Indirect, incidental, or consequential damages
- Lost revenue, lost leads, or business losses
- Downtime caused by third parties
- Issues arising from third-party accounts (Google, domain host, email provider, etc.)
- Client misuse of the website or failure to comply with regulations
Liability is limited to the total amount Client has paid under this Agreement.
12. Portfolio Rights
Developer may display the completed work in marketing materials and portfolios unless Client requests otherwise in writing.
